The Plaintiffs in this case sued the operator of the nightclub doing business as “Larry Flynt’s Hustler Club” in Washington Park, Illinois. The Plaintiffs allege that the club violated the Illinois Biometric Information Privacy Act (“BIPA”) by having customers place their fingerprints on receipts using an ink pad. The operator Deja Vu Showgirls-Washington Park, LLC (or “Defendant”) denies these allegations and denies that it violated the law.
The Court has allowed the claims in this lawsuit to proceed as a class action on behalf of all individuals whose ink fingerprints were placed on a receipt for a transaction at Larry Flynt’s Hustler Club in Washington Park, Illinois from August 10, 2016, to July 7, 2025 (the “Class”). The Court has not decided whether the Defendant did anything wrong. There is not yet any money or relief available and no guarantee that there will be.
Class counsel must prove the claims against the Defendant at an upcoming trial that has not yet been scheduled. If money or benefits are obtained from the Defendant, you will be notified about how this relief will be distributed.
